Phoenix Auto Glass – Legal Notice & Terms of Service

1. Introduction

This website and all related services are owned and operated by Phoenix Auto Glass (Pty) Ltd, based in Blackheath, Western Cape, South Africa (“Phoenix Auto Glass”, “we”, “our”, or “us”).

By requesting a quotation, booking a service, or making payment, you (“the customer”, “you”, or “your”) agree to the following terms and conditions. These terms comply with the Consumer Protection Act, 68 of 2008 (“CPA”), and any other applicable laws of the Republic of South Africa.


2. Service Area & Call-Out Fees

  • Our standard service area is within a 30km radius of Blackheath, Western Cape.

  • Travel outside this area will incur a surcharge of R5.50 per kilometre (one way).

  • A flat call-out fee applies for nearby areas, starting from R350, depending on distance and accessibility.

  • All pricing is quoted excluding VAT, unless otherwise stated.


3. Quotations

  • All quotes are valid for 7 (seven) days from date of issue and are subject to availability of stock.

  • Pricing is subject to change without prior notice, including within the 7-day validity period, should supplier pricing or other unforeseen costs change.

  • Quotes are provided for specific purposes only. Quotes issued for cash clients may not be used for insurance claims.

  • Misrepresentation of the intended purpose of a quote, or malicious use thereof, may result in legal action.


4. Payment Terms

  • A minimum 50% deposit is required upon acceptance of a quotation. Higher deposits may be required for special or custom orders.

  • The balance is payable immediately upon installation, unless otherwise agreed to in writing before commencement of work.

  • All invoices must be paid in full before completion of the service, unless otherwise agreed.

  • Late or non-payment will result in:

    • Adjustment of all pricing to maximum retail value,

    • Interest charged on overdue amounts at the legally permissible rate, and

    • Recovery of all legal and collection fees incurred.

  • Once a quotation is accepted, the customer is liable for the cost of the glass, as glass is classified as a consumable product.


5. Installation, Timing & Delays

  • Fitment times are estimates and subject to change due to traffic, supplier delays, or previous job overruns. Phoenix Auto Glass will strive to keep to scheduled times but reserves the right to reschedule without liability.

  • Standard installation includes:

    • Fitment time: ±1 hour

    • Curing/waiting period: Minimum of 2 hours (depending on vehicle type) before the vehicle may be safely driven.

  • No power washing or pressure washing of the vehicle for at least 14 days after installation. Failure to comply will void the installation warranty and may cause damage.


6. Warranty & Repairs

  • Phoenix Auto Glass warrants its installations against defects in workmanship and bonding (leaks) for the warranty period provided at the time of installation.

  • In the event of a fault, Phoenix Auto Glass reserves the right to:

    • Inspect the fault, and

    • Attempt to repair or rectify the issue before the customer seeks third-party repairs.

  • If Phoenix Auto Glass cannot confirm whether the issue was caused by our workmanship, we cannot accept liability for associated costs.

  • Warranty is void if:

    • The vehicle is subjected to pressure washing within 14 days,

    • The installation has been tampered with by third parties, or

    • The glass or bonding is damaged due to external impact, misuse, or negligence.


7. Liability Disclaimer

  • Phoenix Auto Glass shall not be held liable for:

    • Delays due to stock unavailability, damaged stock, or supplier errors,

    • Consequential, incidental, or indirect damages arising from delays, defects, or installation issues,

    • Any damage caused by failure to adhere to post-installation care instructions.

  • Customers are responsible for ensuring that the work area is safe, accessible, and suitable for mobile installation services.


8. Legal Compliance

  • These terms are subject to the Consumer Protection Act, 68 of 2008, and all applicable laws of South Africa.

  • If any provision of these terms is found to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.


9. Jurisdiction

These terms shall be governed by the laws of the Republic of South Africa, and any disputes shall be resolved in the jurisdiction of the Western Cape High Court, unless otherwise agreed in writing.
